FAQ – Workers Compensation Cases

Below is a list of the most frequently asked questions we field from both current and prospective client’s:

1.   If I am injured on the job do I have to sue my employer to receive workers compensation benefits?

Answer: No. Many people we talk to have a legitimate claim for workers compensation benefits, but are reluctant to retain a lawyer because they do not want to sue their employer for fear of repercussions at work. This is a legitimate concern, as most workers like and value their jobs and only want to make sure they can continue to support themselves and their family in the event of an injury. Protection of your rights under the Tennessee Workers Compensation Statute generally does not require either the filing of a lawsuit, or if one is required, the naming of your employer as the party to be sued. If this is a concern or yours, discuss this with us at your free initial consultation and we will be happy to discuss your legal options in order to avoid this.
